⚖️ Avoid These Legal Pitfalls When Renting Your Property

Renting out your property can be a great source of income — but if you’re not careful, it can also turn into a legal minefield.

In the UK, landlords are bound by a growing list of regulations — and missing even one of them can lead to fines, voided tenancy agreements, or worse.

At Citizenz Properties LTD, we help landlords avoid risk, stay compliant, and enjoy stress-free rental income. Here are the most common legal traps — and how to stay clear of them.

🧾 1. Skipping the Right to Rent Check

By law, landlords must verify a tenant’s legal right to live in the UK before the tenancy begins.

Miss this step? You could face a civil penalty of up to £3,000 per tenant.

Solution: Always request valid ID and follow the government’s Right to Rent guidelines — or let us do it for you.

🔧 2. Ignoring Gas & Electrical Safety Requirements

Gas Safety Certificates (CP12) must be renewed every 12 months. Electrical Installation Condition Reports (EICRs) are required every 5 years.

Failing to provide these? Your tenancy could be considered illegal — and any deposit protections void.

Solution: Book inspections on time and keep digital copies of all certificates.

🧑‍⚖️ 3. Mishandling the Tenant’s Deposit

Landlords must protect the deposit in a government-approved scheme within 30 days and provide the tenant with “Prescribed Information.”

Don’t comply? You could owe up to 3x the deposit amount in compensation.

Solution: Use one of the three official schemes (TDS, DPS, or MyDeposits) and keep your records in order.

📝 4. Using Outdated or Unlawful Tenancy Agreements

An old or generic tenancy agreement can leave you exposed — especially with recent changes in housing law.

Solution: Use up-to-date, legally reviewed contracts that reflect current legislation.

🧹 5. Not Issuing the Required Documents

At the start of every tenancy, you must provide:

  • A valid EPC (Energy Performance Certificate)

  • The “How to Rent” guide

  • Gas & electrical certificates

  • Deposit protection information

Skip these? You lose key protections — like the right to issue a Section 21 notice.
